If a person used the bathroom before Maariv, but did not have time to say “asher yatzar” before barchu, he should respond to barchu, but have in mind that he is not “starting” Maariv. He should then say asher yatzar and continue with davening Maariv.

If he did not have this intention, he must not say “asher yatzar” until after shemoneh esrei.
